N. 4/2025 Costituzioni resilienti come garanzia di democrazie militanti?
The argument compares the resilience mechanisms of the German and Italian constitutions in the face of parliamentary threats from populist-authoritarian actors. Constitutional justice, regional division of power and instruments for the dissolution of parties are analysed. The comparative approach shows that defensive capacity derives from previous authoritarian experiences, despite structural lacunae. Italy can draw inspiration from the German reform of the Constitutional Court, while both forms of regional divisions of power are proving to be solid Limitations remain in the applicability of the ban on parties. The result clearly shows that a stable constitution requires solid institutions and constant defence by democratic actors.
