ABSTRACT

The legal requirements and limits of party autonomy are difficult to define. Provisions that deal with party autonomy often are sparse or overly vague. Efforts by courts to concretize such provisions and party autonomy in general risk being perceived as arbitrary or incoherent. The aim of the conference is to explore the scope and limits of party autonomy by means of comparison. For this purpose, we will examine the dimensions of party autonomy in various areas of German and Italian civil law.
