Within the framework of the German-Italian cooperation (Deutsche Forschungsgemeinschaft – Villa Vigoni).
The decades-long dispute opposing Italy and Germany on WWII crimes reparations reached a turning point when two distinct judicial proceedings were filed before the International Court of Justice and the Italian Constitutional Court in 2022. The conference aims to discuss these recent as well as forthcoming developments from a tripartite constitutional, international, and comparative law perspective. Additionally, it aims to trigger a reflection on the complex relationship between the principle of state immunity, as encompassed by the international rule of law, and fundamental rights (including the right to a judge). Ultimately, it aspires to suggest possible ways out of this interstate saga within a common European horizon.
