Antitrust damages claims have long been characterized by tensions with national legal paradigms, despite partial harmonization through the Antitrust Damages Directive (2014/104/EU). More recently, the Court of Justice of the European Union (CJEU) has increasingly classified general liability requirements as matters of EU law rather than national law. The German-Italian seminar shall examine the impact of CJEU’s case law on traditional liability paradigms in both countries. In addition, the seminar will explore solutions that have emerged for non-harmonized aspects of private enforcement, including claims against “Big Tech” companies under the Digital Markets Act.
